Any refugee hearing in which CBSA actively participates and/or in which exclusion is raised, identified, or remains an issue to be determined is treated as a non-routine hearing, regardless of whether CBSA ultimately attends, withdraws, or elects not to appear. Includes preparation for the hearing and representation at the hearing, and applies regardless of whether CBSA attends or participates, and regardless of the decision or outcome.

| Response to Procedural Fairness Letter under s. 101(1)(b.1) IRPA (Bill C-12) for Non-Pax Law Clients – Principal Applicant |
For clients who are not existing Pax Law refugee clients and retain us to respond to a procedural fairness letter concerning possible ineligibility under section 101(1)(b.1) of the Immigration and Refugee Protection Act arising from Bill C-12. Includes review of the procedural fairness letter, review of the client’s relevant documents and immigration history, preparation of one written response submission, and communication of that response to the appropriate immigration authority. Covers only the initial response and does not include further submissions, follow-up correspondence, interviews, hearings, judicial review proceedings, or ongoing representation.
